Terms

This statement contains the standard terms and conditions for our agreement. Unless modified in writing or by mutual agreement, these terms will be an integral part of any agreement we may have with you. The buyer must review this statement carefully before the contract is confirmed and contact us immediately if you have any questions. Please retain this statement for reference.

Parties

In the following conditions, the contract is made between Armstrong Scaffolding Ltd (referred to as Owner) and the company, person, corporation, or public authority hiring scaffolding and/or ancillary equipment from the owner (referred to as Buyer).

Contract Terms

This statement contains the standard terms and conditions of our agreement for the contract of hire, erection, and dismantling of scaffolding and all associated services provided by the Owner. If the Buyer accepts the quotation and has had the existence of these conditions brought to their attention, the act of hiring equipment again from the Owner will be conclusive proof that the Buyer agrees to be bound by these terms.

Ownership of Scaffolding and Rights of the Owner to Remove Scaffolding

All scaffolding remains the property of the Owner. Upon termination of the contract, the Owner may, without notice, retake possession of the scaffolding.

GDPR

Armstrong Scaffolding Ltd holds and stores data in both physical and electronic formats. This data, including names, email addresses, phone numbers, and business/property addresses, is solely used to provide quotations and complete contracts. No data is sold, and it is only shared as required to fulfill agreements.

Duration of Hire

The hire of equipment begins on the delivery day and continues until the Buyer provides notice (via phone or written form) to off-hire the equipment. No reductions in hire charges will be made for holidays, weekends, or inclement weather.

Hire Period

The standard hire period is 6 weeks from each stage of completion unless otherwise stated in the quotation. The Buyer must provide 5 clear days’ notice for removal before the minimum hire period expires. Additional charges apply if notice is not given.

Hire Charges Per Week

After the 6-week period, the Buyer will be charged 3% of the total item price per week automatically.

Standard Working Hours

Scaffold installation occurs Monday to Friday, 7:00 AM to 6:00 PM, excluding statutory holidays. Work outside these hours will incur additional charges.

Quote Validity Period

Quotes are valid for 28 days from the quotation date unless otherwise agreed. If permit or license costs increase during this period, the Owner reserves the right to adjust pricing accordingly.

Retentions

No retention or discount shall be deducted from any payments made by the Buyer to the Owner.

VAT

All costs are subject to VAT at the applicable rate. Any modifications to VAT must be confirmed in writing by the Buyer’s accountant.

Aborted Visit Costs

If the Owner cannot complete the quoted work during a visit due to access issues or obstructions, a minimum abortive charge of £350 will apply.

Credit Terms

Payments are Net 30 days end of month, unless otherwise agreed. Any invoice queries must be raised within 14 days.

Non-Payment

If full payment is not received by the end of the month following the invoice date, the Owner reserves the right to:

  • Charge 5% interest above the base rate on overdue amounts.

  • Remove all equipment from the site, regardless of work completion.

  • Cease work and suspend supply of equipment and labor.

Day Work

Minor scaffold alterations requested by the Buyer can be performed on a day work basis. Time records will be kept and, where possible, must be authorized by the Buyer or their representative.

Extra Works

Additional scaffold requirements or modifications beyond the original quotation will be charged separately. The Owner will issue a quote for these works, but if modifications proceed without prior written confirmation, the Buyer will still be liable for the costs.

Site Surveys

The Owner requires a minimum of 48 hours’ notice (two clear working days) for any site visits.

Handover/Scaff Tag

Scaffold must not be used before the Hand-Over Certificate is signed. The Owner will conduct safety checks, complete Safety Tags, and maintain Scaffold Registers, which can be provided at an additional cost.

Electric Cable Sheathing

No provisions for power line sheathing are included unless specifically stated.

Safety of Equipment

Once a Hand-Over Certificate/Scaff Tag is issued, the Buyer assumes full responsibility for the scaffold’s safety. The Owner is not liable for losses or damage resulting from unauthorized alterations.

Extension of Contract Due to Unforeseen Issues

The Owner is not responsible for contract extensions caused by factors beyond their control. Extensions will incur additional charges.

Damage to Roofs

The Owner will take reasonable care but will not be held responsible for damages to flat roofs, slates, tiles, roof sheeting (including asbestos), downpipes, or guttering during scaffold erection or dismantling.

Design Drawings

Unless specified, design drawings are not included in standard quotations. If required, costs will be provided, and immediate payment will be necessary.

Scaffold Loading

The Buyer must specify the intended use and load requirements before finalizing the contract. If alterations are required due to changes in these requirements, additional charges will apply.

Scaffold Ties

The Buyer must allow for scaffold ties to be secured to the building. Any restrictions on tie fixings must be communicated in writing before the contract is finalized.

Satellite Dishes and Aerials

The Owner is not responsible for any loss of signal due to scaffold erection near satellite dishes or aerials.

Licenses

Upon request, the Owner can obtain necessary licenses and permits at an additional cost.

Easements and Access for Scaffold Erection/Dismantling

The Buyer is responsible for securing permissions required for scaffolding that encroaches on adjoining properties or areas outside their control.

Claims

The Buyer assumes all risks associated with the scaffold and indemnifies the Owner against any claims except those arising due to the Owner’s negligence.

Ground Conditions

The Buyer must ensure that scaffolded areas have solid, level ground. Additional charges apply if extra materials or labor are needed due to unsuitable ground conditions.

Equipment Care

Platforms must be left clean and tidy upon completion. Failure to do so may result in an aborted visit charge.

Welfare Facilities

The Buyer must provide welfare facilities as required by current regulations at no cost to the Owner.

Advertising

The Owner reserves the right to place advertising on all scaffolding.

MACDECK Safety Decking

The MACDECK system is a fall prevention platform. Any falls or heavy loading beyond 2.0kN per m² must be reported immediately. Work must stop until the system is inspected and approved for continued use.
